1. Introduction and Acceptance
Welcome to Pocket XL Bullies (the "Company", "we", "our", or "us"). We are a family of Pocket Bully and XL American Bully lovers, a Canadian-based company connecting buyers with a nationwide network of vetted, independently owned partner breeders, operating from 984 Morningside Dr, Nanaimo, BC V9T 1N5, Canada. These Terms and Conditions ("Terms") govern your use of our website and any services we provide, including adoption applications, puppy inquiries, and video consultations (FaceTime, WhatsApp, or Zoom). By accessing or using our site and services, you ("User", "you", or "your") agree to be bound by these Terms. If you do not agree, you must not use our site or services.
Important note on legally binding nature: These Terms form a legally binding contract between you and Pocket XL Bullies. Your continued use of our services constitutes acceptance of these Terms.
2. Eligibility and User Responsibilities
2.1 Age Requirement. You must be at least 18 years of age to use our site, submit an adoption application, or enter into any agreement with us.
2.2 Accurate Information. When submitting an adoption application, contacting us, or using any of our services, you agree to provide accurate, current, and complete information.
2.3 Prohibited Activities. You agree not to misuse our site or services, including: using the site for any unlawful purpose; engaging in fraudulent, deceptive, or misleading practices; interfering with the proper functioning of the site; collecting personal information about other users without consent; scraping the site with automated tools; or making false or misleading statements about our dogs, breeding practices, or your intentions.
3. Adoption Applications and Video Consultations
3.1 Adoption Application Process. All applications are subject to review and approval by Pocket XL Bullies. Submitting an application does not guarantee approval. We reserve the right to refuse any application at our sole discretion.
3.2 Video Consultations. By scheduling a video call, you agree to provide accurate contact information, conduct the call respectfully, acknowledge we do not record sessions without prior written consent, and understand that calls are informational and do not constitute a sale or guarantee of adoption.
4. Intellectual Property Rights
All content on our site — text, graphics, logos, images, videos, and software — is the exclusive property of Pocket XL Bullies or our licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the site for personal, non-commercial use. You may not reproduce, distribute, or modify content, use our trademarks without consent, or frame/mirror any part of our site elsewhere.
5. Official Channels & Financial Security
5.1 Official Email: All electronic transactions, invoices, and contracts will be dispatched exclusively from info@pocketxlbullies.com.
5.2 Secure Invoicing: We will never request deposits via wire transfer, check, or gift cards. Any payment request from an email address other than info@pocketxlbullies.com should be treated as fraudulent and reported to us immediately — see our Scam Awareness page.
6. Disclaimer of Warranties
Our site and services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Pocket XL Bullies disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. No Guarantee of Adoption Success: We do not guarantee that any particular puppy will be available, that your application will be approved, or that you will be satisfied with any puppy you adopt. Temperament, health, and appearance are subject to natural variation.
7. Limitation of Liability
To the fullest extent permitted by law, Pocket XL Bullies, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our site or services, including loss of profits, personal injury or property damage, claims arising from the health, temperament, or behavior of any dog, or errors or omissions in information provided. Our total liability to you shall not exceed the total amount you paid us, if any, for the services giving rise to the claim.
8. Indemnification
You agree to defend, indemnify, and hold harmless Pocket XL Bullies, its owners, employees, and affiliates from any claims, damages, losses, costs, and fees arising out of your use of our site or services, your breach of these Terms, your violation of any law or third-party rights, or any false or misleading information you provide.
9. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of British Columbia, Canada. Any dispute shall be resolved exclusively in the courts of Nanaimo, British Columbia, Canada, and you agree to submit to the personal jurisdiction of these courts.
